Welcome to Verdant Roots. By accessing or using our website, placing an order, booking a service, or signing up for an Annual Maintenance Contract (AMC), you agree to be bound by the following Terms of Service. Please read them carefully. If you do not agree, please do not use the site.
1. Definitions
"We", "us", "our" refers to Verdant Roots. "You" refers to the visitor or customer using our site or services. "Services" includes garden design, installation, plant-doctor consultations, AMC plans, plant rental, and any other service we offer. "Products" includes plants, pots, soil, tools, and any physical item sold on our site.
2. Use of the site
You agree to use the site for lawful purposes only. You will not attempt to gain unauthorised access to any part of the site, related systems, or networks. You will not use the site to transmit any malicious code, spam, or content that is unlawful, defamatory, or infringing.
3. Account registration
To place an order, book a service, or sign up for an AMC, you may need to create an account. You agree to provide accurate, current, and complete information, and to keep it updated. You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately if you suspect unauthorised access.
4. Orders and pricing
All prices are listed in Indian Rupees (INR) and include GST unless explicitly stated otherwise. We reserve the right to refuse or cancel orders in the event of stock errors, pricing errors, or suspected fraud. If we cancel an order after payment, we will issue a full refund to the original payment method within 7-10 working days.
5. Shipping and delivery
We ship live plants across India via specialist plant couriers. Delivery windows are estimates, not guarantees. We are not liable for delays caused by the courier, weather, strikes, or other events beyond our reasonable control. Please see our Shipping Policy for full details.
6. Returns and refunds
Live plants carry a 14-day establishment guarantee. If your plant fails in this window, we will replace it or refund the full amount. Services and AMC plans are governed by our Refund and Cancellation Policies.
7. Services and AMC
Service visits are scheduled within an agreed window. We may reschedule due to weather, pest outbreaks, staff illness, or site access restrictions. We will always communicate changes in advance. AMC plans renew automatically for 12 months unless cancelled before the renewal date.
8. Intellectual property
All content on this site — text, images, logos, designs, plant photos, garden plans — is owned by Verdant Roots or our licensors and protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works without our written permission.
9. User content
If you post reviews, photos, or other content on our site, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content in connection with our services. You confirm you have the right to grant this licence and that the content does not infringe any third-party rights.
10. Third-party links
Our site may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of those sites. Following a link is at your own risk.
11. Disclaimer of warranties
The site and its content are provided "as is" and "as available". We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for any particular purpose of the site or its content. Plant growth depends on many factors beyond our control (sunlight, watering, climate, pests), and we do not guarantee specific outcomes.
12. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to your use of the site or services is limited to the amount you have paid us in the 12 months preceding the claim. We are not liable for any indirect, incidental, special, or consequential damages.
13. Indemnification
You agree to indemnify and hold us harmless from any claim, demand, or damage (including reasonable legal fees) arising out of your breach of these Terms or your use of the site.
14. Termination
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms. You may close your account at any time by contacting us.
15. Governing law and dispute resolution
These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka. We will first attempt to resolve any dispute informally by contacting you; if that fails, we will pursue formal resolution.
